Breaking: Outrigger Withdraws Appeal, No Warehouse Coming to Franklin Mint Site

Just a few minutes ago, Middletown Township released the following statement via email:

Outrigger Withdraws Land Use Appeal Against Middletown Township

Outrigger Industrial Acquisition, LLC has withdrawn its appeal challenging a land development application denial by the Middletown Township Council, filing a praecipe to discontinue the case in the Delaware County Court of Common Pleas on August 10, 2026.

A brief history of the case –

  • The applicant filed a land development application for a warehouse use on the site while the Township was in the process of adopting a revised zoning ordinance.
  • Pursuant to State Law, the applicant was entitled to consideration under the previous zoning ordinance.
  • The Township considered the application, per the PA Municipalities Planning Code and notified the applicant of a decision on August 20, 2025.
  • The applicant filed its appeal within the permitted 30-day appeals window.
  • The applicant withdrew its appeal on August 10, 2026.
  • The circumstances behind this withdrawal and the statutory time clock mandate that any future proposed development on the site must follow current zoning standards.

The Township appreciates the resolution of this matter and looks forward to working with all stakeholders on future development of the site.

Of note: any future proposed development on the site must follow the new zoning ordinance set in January of last year. That ordinance does not allow for a warehouse on that plot of land.
